Terms

Last updated 18 August 2026

These terms set out the basis on which you use this website and book a Momentum Session with Xennial. Xennial is a trading name of Expert Marketing Ltd, a company registered in New Zealand. If anything here is unclear, please ask us before you book.

1. Using this website

You are welcome to browse this website and use it for your own business purposes. Please do not attempt to interfere with the site, copy it wholesale, or use it in a way that breaks New Zealand law.

The information on this site is general in nature. It is not tailored advice for your business and should not be relied on as though it were. Tailored advice is what the Momentum Session is for.

2. What the Momentum Session is

The Momentum Session is a two hour working session with two Xennial Fractional CMOs, held in person in Auckland or over video anywhere in New Zealand. After the session you receive a short written summary setting out the three marketing priorities we recommend, ranked in the order we suggest you tackle them.

The session is advisory. It does not include implementation of the recommendations, ongoing marketing services, design or production work, media spend, or any deliverable beyond the written summary. If you would like help putting the priorities into action, we will quote that separately and you are under no obligation to accept.

3. Booking and payment

Submitting the booking form on this website is a request for a session, not a confirmed booking. We will come back to you to agree a time. Your booking is confirmed once we have both agreed the date and time in writing, including by email.

The fee is $500 plus GST for the session. We invoice after the booking is confirmed, and payment is due within seven days of the invoice date unless we have agreed something different with you in writing.

4. Rescheduling and cancellation

Things come up, and we would rather move a session than run a poor one. If you need to reschedule, please give us at least two working days notice and we will find a new time at no extra cost.

If you cancel with less than 24 hours notice, or the session does not go ahead because nobody from your business attends, we may charge the full fee. If we need to reschedule, we will give you as much notice as we can and will not charge you anything extra.

5. What we need from you

The quality of the session depends on the quality of what you bring to it. To get the most out of it, please make sure a decision maker attends, and share the background we ask for beforehand. If information you give us is incomplete or inaccurate, our recommendations may be affected.

6. Confidentiality

What you tell us in the session stays between us. We treat your business information as confidential and will not share it with anyone else without your permission, unless we are required to by law.

We ask the same of you in return. The written summary and the thinking behind it are prepared for your business and are not for sharing with our competitors.

If we would like to mention that we have worked with you, or use a quote from you, we will ask you first.

7. Intellectual property

Everything on this website, including the text, images, branding and layout, belongs to Expert Marketing Ltd or is used with permission. Please do not reproduce it without asking us.

The written summary from your session is yours to use inside your business however you like. The frameworks, methods and tools we use to produce it remain ours.

8. No guarantee of results

We bring experience, judgement and honest thinking to your business, and we stand behind the quality of our advice. What we cannot do is guarantee a particular commercial outcome. Results depend on how the recommendations are carried out, your market, your team and plenty of things outside anyone's control.

9. Liability

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply to you. Where you are acquiring our services for the purposes of a business, the Consumer Guarantees Act does not apply and the parties agree to contract out of it to the extent permitted.

To the extent the law allows, our total liability in connection with the Momentum Session is limited to the fee you paid for it. We are not liable for indirect or consequential loss, including lost profits, lost revenue or lost business opportunity.

10. Privacy

We collect and use your personal information in line with our privacy policy. In short, we use the details you give us on the booking form to get back to you about your session, and we do not sell your information to anyone.

11. Changes to these terms

We may update these terms from time to time. The version published on this page when you confirm your booking is the version that applies to that booking.

12. Governing law

These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction over any dispute arising from them.

13. Getting in touch

If you have a question about these terms, or something has not gone the way you expected, please talk to us first. We would rather sort it out directly.
